Booking Conditions

 

 

1. China Panorama Travel (China West and Beyond) is a company registered both in Kunming, China and Melbourne, Australia.
2. The contract: these booking conditions contain important information. It is essential that you read them carefully since they form the conditions of the contract between you the client and us, the tour operator. Acceptance of your booking will be confirmed in writing to you or your travel agent and a contract comes into existence on the date shown on your confirmation letter or email.
3. The prices shown are on a twin share basis and are in US. Dollars and are based on the costs and exchange rates at the time this brochure is printed.
4. To make a booking: China Panorama Travel (China West and Beyond) needs a completed booking form and the necessary deposit or full payment at least 60 days prior to departure. Persons booking by fax, e-mail or telephone will be deemed to have read these terms and conditions and have signed the booking form.  
5. Payment for your tour: if you are booking prior to 60 days of departure you will need to send 10% of the total cost as deposit. The balance must be paid no later than 60 days before departure or immediately if booking less than 60 days prior to departure. In the event of non payment of the balance, we reserve the right to cancel your booking and cancellation charges will apply. A surcharge of 1% will be levied if the final balance is paid by credit card.  
6. Cancellation by you: should you wish to cancel your booking, the following charges will apply calculated from the day notice of your cancellation is received by us in writing. 
 * more than 60 days prior to departure - retention of deposit.
 * between 30 and 59 days prior to departure - 50% of the total tour price.
 * less than 30 days prior to departure - 100% of the total tour price.  
7. Cancellation by us: we will only cancel your tour if:
A) We are forced to do so by forces beyond our control such as war, civil unrest, major weather or health events or 'force majeure' or. 
B) Because the minimum number of bookings needed to operate the tour have not been reached.  
In either case we will offer you an alternative tour , if possible. If not possible or acceptable to you then we will refund all payments made to us with the exception of any incidental expenses you may have incurred. 
8. Changes to the tour: you understand that tours in this region require a certain flexibility of attitude - the itinerary, accommodation and/or modes of transport may change even after the tours commences. Changes may occur because of  'force majeure', poor road conditions, water  or weather conditions, vehicle breakdowns, changes in transport schedules or other circumstances beyond our control. China Panorama Travel (China West and Beyond) does not accept any responsibility for delays and or loss of enjoyment due to such events. We will do all we can to make suitable alternative arrangements.  We reserve the right to pass on extra costs to the client due to changes in the itinerary that are beyond our control.  
9. Authority of the tour leader: at all times the decision of the tour leader will be final on all matters likely to affect the safety and viability of the tour and its clients. Should you not comply or seek to interfere with the tour leaders decision, we reserve the right to terminate your participation in the tour with no right to a refund.  
10. Complaints: if you have any complaint about the tour you should make it known immediately to the tour leader or our local representative so that appropriate action can be taken. If you are not satisfied you must notify us within 30 days of the completion of the tour.  
11. Liability: except to the extent that the law imposes a non-excludable liability, China Panorama Travel (China West and Beyond) accepts no liability for the negligence, losses or damage caused by its agents. This company does not own, manage, operate or control any transportation vehicles, hotel, restaurants or other service suppliers.  
12. Insurance: adequate and valid insurance is compulsory for all our clients. Your insurance must cover accidents, injury, illness, death and all medical, hospital and evacuation expenses. We also strongly recommend such insurance cover loss or damage to personal belongings and adverse events relating to the tour. You must carry proof of insurance with you at all times and make it available for inspection by the tour leader at the commencement of the trip. Failure to do so may result in your immediate exclusion form the tour with no right to a refund. 
13. Passports and visas: all clients must have a current passport with at least 6 months validity beyond the duration of your trip and also have the appropriate visa/s.  
14. Vaccination and inoculation we strongly advise you to consult your doctor and/or your government website for necessary information. We cannot be responsible for any problems arising from your failure to do so.  
15. Surcharges: we will absorb fluctuations in exchange rates or increased costs of up to 1%. Surcharges may, however, be imposed 6 weeks prior to departure due to rises in excess of 1%.
16. Law of contract: the law of P.R.China and Victoria, Australia shall be deemed to be the law governing any dispute arising from this contract.
